Advising Legal and General in relation to a proposed new village on Wisley Airfield, which is located in the Green Belt, these proposals were being developed on the basis of arguments relating to it being a 'major developed site in the green belt' under Annex C of PPG2.
On the basis of my advice as to the non-compliance with the parameters of Annex C and unpropitious EU habitat designations, the site was sold for waste purposes. I acted for the purchaser, in successfully making representations and assisting in presenting the case at the EIP for the Surrey Waste Plan, in relation a favourable policy designation for the site to enable it to be considered for heat treatment processes.
Key issues included:
- Green belt and very special circumstances - in this case I advised that the case was not sufficiently strong to justify proceeding with the application: this can be an important decision if the merits of the case are not sufficient to outweigh the harm of inappropriate development in the green belt.
- Conservation and habitats protection.
- Transport and sustainability.
The original guru on planning and all things CPO was a guy called Paul Winter. He's since left Eversheds and set up on his own. I think he's the best planning lawyer/adviser in London.
